An Indian Franchise Entrepreneur Immigrates to Canada.

Published: December 14, 2021 Updated: February 26, 2026

From India to Canada Through Purchase of a Franchise

Our Client, an experienced restaurant manager with nearly 20 years of experience in managing retail locations of large franchises, contacted us to advise him on the possibility of purchasing a franchise in Canada. The Client had a budget of around $300,000. His business immigration goals were as follows:

  • With significant knowledge of the franchise restaurant business, he wanted to use his expertise in Canada but he was open to other franchising opportunities;
  • He wanted to start a franchise in a location with a large enough consumer market to support the operations of the new business;
  • The Client wanted to immigrate to Canada in 2021;
  • To bring his family (a spouse and 1 child) to Canada;

Taking into consideration the Client’s key priorities and required timelines, our team completed thorough research and proposed several franchising opportunities. The Client chose an existing franchise location in Richmond, British Columbia over opening a new location. Extensive due diligence was completed, and the Client signed a purchase agreement with a franchisor company. The Client would initiate operations on May 1, 2021.

The Timeline of the Case

The first step that our Client had to take was to invest in purchasing a franchise. This investment was essential as it allowed our Client and his spouse to be eligible for open work permits, and their child to be eligible for a student visa and subsequent study permit.

On behalf of our Client, we submitted the entrepreneur visa application under the C11 program to the Canadian Visa Office in New Delhi on March 22, 2021. This program is one of many business immigration options that are available to Indian nationals looking to immigrate to Canada to do business.

On this occasion, our Client’s file was delayed for several reasons. Firstly, the Canadian business location changed as our team was preparing the application. However, we continued the application once the new location was finalized. Secondly, due to the worsening COVID-19 situation in India at the time, processing took longer than expected. We submitted multiple processing requests and coordinated with the franchisor to protect the Client’s interests and delay the starting date of the Canadian operations.

After successfully mitigating the delays, we received an approval for our Client’s application on October 27, 2021. The entire family has arrived in Canada in December 2021 just in time for the holiday season!

Key Takeaways from the Case

There are many factors that your business immigration lawyer should take into consideration when advising you on your situation. One of the most important ones is to use Client’s strengths to not only bolster the immigration application but also to choose the most favourable immigration route. The Client’s education, skills, and work experience should be assessed alongside Client’s business immigration ambitions and goals.

In this case, after assessing our Client’s characteristics and his immigration priorities – he was perhaps a model candidate for immigration through the purchase of a franchise. Client’s budget, work experience, and immigration priorities perfectly aligned with the requirements of immigration by purchasing a franchise.
