What is a Canada tech visa?
There is no single “tech visa” in Canada. When people use the term, they usually mean a work permit that lets a software, data or IT specialist work for your company in Canada.
Canada offers several fast routes for tech hires. Some need a Labour Market Impact Assessment (LMIA). Others don’t. The right one depends on who you are hiring, where they are from, and how your company is structured.
Hiring foreign tech talent t a glance
Key takeaway
Pick the route before you make the offer. The fastest option for one hire can be the wrong one for the next — a nationality, a job duty or a corporate link can change everything.
Which work permit route fits your tech hire?
Most tech employers use one of these five routes. Each card shows who it fits and the trap we see most often in our practice.
Global Talent Stream
Best for
Hiring software engineers, developers, data scientists and other in-demand tech roles from anywhere in the world.
Watch out
You must pay at least the prevailing wage and keep the promises in your Labour Market Benefits Plan.
Intra-Company Transfer
Best for
Moving an executive, senior manager or specialized-knowledge employee from your foreign office to a related Canadian company.
Watch out
The worker needs at least one year of full-time work with the related company abroad in the last three years.
Free trade agreement professionals
Best for
Citizens of the US, Mexico, the EU, the UK and other partner countries in listed professions, such as computer systems analysts.
Watch out
Each agreement has its own list of professions and education rules. A job title alone is not enough.
Innovation Stream
Best for
High-skilled hires at companies designated under the Global Hypergrowth Project. Permits can last up to five years.
Watch out
Only designated employers qualify. The pilot currently runs to March 22, 2028.
Standard LMIA
Best for
Roles that don’t fit any faster route, including some senior or niche tech positions.
Watch out
Expect recruitment ads, a wage review and longer processing than the Global Talent Stream.
How does the Global Talent Stream work?
The Global Talent Stream (GTS) is a fast-track LMIA for tech and other in-demand roles. It is part of Canada’s Global Skills Strategy. Your company applies to Employment and Social Development Canada (ESDC) first. Then your worker applies to IRCC for a work permit.
- For innovative companies with a unique, specialized talent need.
- You must be referred by one of the program’s designated referral partners.
- You commit to creating jobs for Canadians and permanent residents.
- For roles on the Global Talent Occupations List.
- The list includes software engineers, software developers and programmers, data scientists and computer engineers.
- You commit to investing in skills and training for Canadians.
- Pay at least the prevailing wage for the role and region.
- Pay the $1,000 LMIA processing fee for each position.
- Prepare a Labour Market Benefits Plan and report on it.
- Keep records. ESDC can review your compliance later.
-
Step 01
Confirm the route
Check the role’s NOC code and duties against the GTS lists and any LMIA-exempt option.
-
Step 02
Apply for the GTS LMIA
Submit your application and Labour Market Benefits Plan to ESDC. The target is about 10 business days.
-
Step 03
Worker applies for the permit
With a positive LMIA, your worker applies to IRCC. The target is 2 weeks for complete applications from outside Canada.
-
Step 04
Start work and stay compliant
Pay the promised wage, meet your benefits plan and keep records for inspections.
Which trade agreements let you skip the LMIA?
Canada’s free trade agreements let many professionals, technicians and intra-company transferees work in Canada without an LMIA. Your worker must be a citizen of a partner country and meet the agreement’s rules for their profession.
- CUSMA (formerly NAFTA): United States and Mexico
- Canada–Chile, Canada–Peru, Canada–Colombia and Canada–Panama agreements
- CETA: citizens of the 27 European Union member states
- Canada–UK Trade Continuity Agreement: United Kingdom
- CPTPP: Australia, Brunei, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore and Vietnam
- The United Kingdom joined CPTPP for Canada on September 1, 2026
- Canada–Korea agreement: South Korea
The General Agreement on Trade in Services (GATS) covers some professionals from World Trade Organization member countries, but only in limited occupations and for short stays.
Tip
Agreements change. Before you build a plan around one, confirm that your worker’s citizenship, profession and education match the current rules.
How long does it take to hire a tech worker?
Timing depends on the route and on where your worker applies. These are government service targets, not guarantees. IRCC aims to meet the 2-week standard in 80% of complete cases.
| Step | Service target | What can slow it down |
|---|---|---|
| GTS LMIA | About 10 business days | A weak Labour Market Benefits Plan or a wage below the prevailing rate |
| Work permit (Global Skills Strategy) | 2 weeks, applying from outside Canada | Missing documents, slow biometrics or a role outside TEER 0 or 1 without a GTS LMIA |
| Short trips (GSS exemption) | No work permit needed | Only for 15 days once every 6 months, or 30 days once a year, for eligible high-skilled work |
| Standard LMIA | Varies by stream and region | Recruitment ads, wage review and ESDC backlogs |
Targets as of October 2026. Check the IRCC and ESDC websites for current processing times.
What mistakes delay tech work permits?
Most delays we see in our practice come from the same few mistakes. Each one is easy to avoid if you plan for it.
Choosing the NOC by job title
Why it hurts
Officers compare the duties you list with the NOC description. A mismatch can lead to refusal.
What works instead
Match the real duties to the NOC code first, then write the job offer.
Paying below the prevailing wage
Why it hurts
ESDC will not approve a GTS LMIA if the wage is too low for the role and region.
What works instead
Check the prevailing wage on Job Bank before you set the salary.
Forgetting the family plan
Why it hurts
Since January 2025, not every spouse qualifies for an open work permit, and children no longer do.
What works instead
Check family eligibility before the offer so your candidate isn’t surprised.
Counting on a tech draw for PR
Why it hurts
The 2026 Express Entry STEM category covers engineering and cybersecurity roles, not software developers.
What works instead
Plan PR around Canadian experience and provincial programs as well.
Can your tech workers bring their families?
Yes, family members can usually come with your worker. Whether they can work depends on your worker’s job.
-
Spouses and common-law partners
Can get an open work permit if your worker is in a TEER 0 or 1 job, or in an eligible TEER 2 or 3 job, and has at least 16 months left on their permit.
-
Dependent children
Can study in Canada, but no longer qualify for open work permits as of January 21, 2025.
-
Visitor or study options
Family members who don’t qualify for a work permit can still apply to visit or study.
How can tech workers become permanent residents?
Many tech workers accept a Canadian job because it can lead to permanent residence. That is also a strong selling point for you as an employer. These are the main routes.
Canadian Experience Class
Who it fits
Workers with at least one year of skilled (TEER 0–3) work in Canada in the last three years.
Good to know
Language, age and education still affect the CRS score. Invitations depend on each draw.
Express Entry categories
Who it fits
The 2026 categories include STEM (engineering and cybersecurity), plus new ones for senior managers and researchers with Canadian experience.
Good to know
Renewed categories now need 12 months of experience in the last three years.
Provincial Nominee Programs
Who it fits
Workers with a job offer in a province that targets their occupation, such as Alberta’s Accelerated Tech Pathway.
Good to know
Streams change often. BC ended tech-only draws in 2024, and Ontario replaced its old streams in June 2026.
H-1B pathway
Who it fits
US H-1B holders. Canada announced an accelerated pathway in Budget 2025.
Good to know
As of October 2026, IRCC has consulted on it but has not opened applications.
Canada tech visa: frequently asked questions
No. “Tech visa” is an informal term. Tech workers come to Canada on regular work permits, often through the Global Talent Stream, an intra-company transfer or a free trade agreement.
ESDC aims to process GTS LMIAs in about 10 business days. IRCC then aims to process the work permit in 2 weeks for complete applications made from outside Canada. Targets are not guarantees.
Not always. An intra-company transfer, a free trade agreement or the Innovation Stream may let you skip it. If none fits, the Global Talent Stream is usually the fastest LMIA route for software roles.
The government fee is $1,000 for each position. Your worker also pays the work permit fee ($155) and biometrics ($85). You also commit to the wage and benefits plan you submit.
Often, yes. Since January 21, 2025, the spouse qualifies for an open work permit only if your worker is in a TEER 0 or 1 job, or an eligible TEER 2 or 3 job, with at least 16 months left on their permit.
A digital nomad who works only for a foreign employer can usually do so as a visitor, for up to six months. Once they work for a Canadian company, they need a work permit.
No. The Start-up Visa closed to new applicants on December 31, 2025. IRCC has said a new entrepreneur pilot will follow. Founders should look at other entrepreneur work permit programs.
