Example of a Case That We Handled

In August 2018, a high-net-worth, 42-year old Turkish man approached us with a request to assist him with the purchase of a profitable business operating in Canada. He wanted to immigrate to Canada through the investment route. He held a bachelor’s degree and had been employed in a managerial position by a leading company in Istanbul, Turkey for the preceding 5 years. His 2 children were attending schools in Toronto, Canada, and he wanted to relocate to Canada to do business and permanently settle there with his family.

Here is how we assisted this high net-worth client:

Between August 2018 and October 2018, we identified 3 potentially profitable businesses that were for sale in Toronto, Canada. Our team:

  • Examined each company’s tax filings for the previous 3 years
  • Reviewed the most recent GST (Good and Services Tax) filings to determine the volume of current sales
  • Visited the locations where the businesses were operating
  • Spoke with the owners to inquire about the reasons why the businesses were being sold

We reviewed all of the important corporate documents and paperwork to ensure that the businesses were in good standing, did not have any “surprise” obligations and were in possession of all licenses, permits and agreements necessary to continue operating. Based on our detailed report, the client selected the most promising business to purchase.

  • From November 2018 to December 2018, the purchase and sales transaction for the business was completed. Per the agreement, the former business owner remained in the business for another 3 months while the new owner obtained necessary authorizations from the Canadian immigration authorities.
  • In January 2019, we applied for an Owner/Operator LMIA (Labor Market Impact Assessment) for our client.
  • In February 2019, the Owner/Operator LMIA was approved.
  • In March 2019, the client applied for a work permit to work in Canada.
  • In June 2019, the client’s Canadian work permit was approved.
  • In July 2019, the client applied for permanent residency under the Express Entry program using the 200 points obtained by way of the job offer made to him by his own Canadian company.

Why Businesses and Business Owners Need Legal Assistance

Foreign companies and individuals can apply for immigration on their own, however, the process is complicated and slow as it depends on the assessments made by third-party officials. Since immigration laws, policies and procedures change very quickly at times, immigration officers, who are not lawyers, are constantly faced with interpreting new and complex laws and regulations. As such, if an immigration officer refuses an application with little justification, lawyers are able to challenge these unfavourable decisions by using currently established caselaw.

This is the major reason why it is not only wise but also cost-efficient to work with immigration lawyers like Sobirovs Law Firm. When we present our clients’ cases, they are set out clearly and concisely so that the process is simplified and expedited. This results in quicker turn around times and enables our clients to get set up in Canada sooner.
