Turkish Entrepreneur Secures Canadian Permanent Residency in 4 Months!

If you are currently working in Canada as a business owner, you can become eligible to apply for permanent residence after accumulating 12 months of self-employed work experience in Canada.

This case study is about one of our clients who arrived in Canada in 2022 as a self-employed professional to establish and run his e-commerce business. After running his business successfully for 1 full year in Canada, our client, Mr. T.A., applied for permanent residence in Canada. His permanent residence application was finalized in just 4 months.

Background information:

Mr. T.A. and his spouse are accomplished entrepreneurs who started and ran an e-commerce business in Australia in 2020. His business focused on trading consumer electronic products with a narrow focus on personal health electronics. Mr. T.A., a Turkish national, originally started his business in Australia but later expanded to the North American market after seeing increased orders from customers located in Canada and the USA.

In 2021, Mr. T.A. retained our law firm to assist with his business expansion plans to Canada. Our firm successfully represented this entrepreneur family in their relocation journey under the Intra-Company Transfer Program. Our team assisted Mr. T.A. in registering his company in Canada, securing his first commercial lease, conducting feasibility studies and preparing a solid business plan to enter and position their products in the Canadian market.

In 2022, Mr. T.A.’s application to come to Canada as an Intra-Company Transfer was approved, and the couple relocated to Canada shortly after their approval.

Step 1: Compliance: We assisted Mr. T.A. in staying compliant with the conditions of his work permit and preparing for the permanent residence application under the Express Entry program.

Step 2: Developing a Strategy for Arranged Employment points (200 points): Mr. T.A. came to Canada as an executive of a new business. It is usually challenging for business owners of small companies to claim 200 points for arranged employment in an executive capacity. When there is no clarity about the nature of his duties – proving executive duties (200 points) vs. managerial (50 points) can be challenging and exasperating.

However, a few key strategies can make the process easier and help ensure success. Our team assisted Mr. T.A. to strike the right balance between business realities and immigration expectations. As a result, he successfully claimed 200 points for his arranged job offer and received an invitation to submit his permanent residence application.

Step 3: Filing an Immigration Application: Our team assisted Mr. T.A. in preparing a solid immigration application for permanent residence under the Express Entry Program (FSW class).

Step 4: Approval: About 4 months after submitting our application package to IRCC, we received a letter from the IRCC with the landing instructions for Mr. T.A. and his family!
