Indian IT Business Immigration to Canada: When Your Lawyers Don’t Give Up.

How experienced lawyers can increase your chances in your immigration application

This is one of 3 successful outcomes that we received last week for our clients from India, Trinidad & Tobago, and South Africa.

The success story below reflects the situation in which a dedicated team of professionals persisted and refused to accept “No” as an answer. It also shows that not all initial visa applications result in a desirable outcome. But with the right mindset and approach, the ultimate result is still achievable.

From Bangalore to Canada to Win

A client is a 34-year-old owner of a Bangalore-based IT company in India. The company is a growing web and mobile application development company. With a workforce of 40 employees in India, after conducting extensive market research, the Company has made the business decision to expand its business portfolio to the Canadian market. It is planning to establish, operate and grow its core business practices in Canada by following the business model of the Indian company and fostering a multicultural approach to reach its North American clients.

The Refusal and Reconsideration of the Intra-Company Transfer Application

Our initial application at the heat of the COVID-19 pandemic in Canada was not successful. We submitted the 1st Intra-Company Transfer application on August 24, 2020, and it was refused by the High Commission of Canada in India on February 02, 2021. Being convinced that the application should have been positive, we submitted a reconsideration on March 1, 2021, but it was not accepted by the High Commission. Our team was very surprised with the outcome, but not discouraged at all.

After discussing the negative decision with the Client, we proposed to submit a new application by addressing every concern of the High Commission. The Client agreed and we thank him for his trust placed in our team’s ability.

The New Application and Reiterating that the Client Fully Satisfied the ICT Work Permit Requirements

We obtained the entire file through a request under the Access to Information and Privacy Act (ATIP) and studied each note left by the officer who decided on our client’s application. Then, we resubmitted on March 22, 2021, responding to each concern of the New Delhi office. To our and the Client’s delight, the application was approved on August 09, 2021. The Client has sent his passport to the New Delhi office and is currently waiting for a work visa to be affixed in it. We can’t wait to see our client in person in Canada soon!

The Challenge and the Lesson

In the heat of the COVID-19 pandemic in Canada and around the world, it is hard to predict where the economy is going. Moreover, it’s impossible to foresee where your client’s business ends up in 6-12 months. We must use observations, previous experience, and foresight to serve our clients in the best manner possible. It may be hard and sometimes seem impossible to deliver what the client wants. However, a firm belief in the client’s potential and business acumen encourages us to protest against an unreasonable decision of Canadian authorities with the full force of our legal expertise.

Our lesson from this case is: Don’t be overconfident about the client’s file as you don’t control the decision-making, but never lose your confidence in the client’s cause!
