An Indian Businessman’s Family Moves to Canada Through Bahrain

An international businessman, who owns a large international apparel and textile manufacturing, export, and distribution company, contacted us to advise on the expansion of his brand to Canada. The Client views opening a subsidiary company in Vancouver, Canada as an excellent growth opportunity due to Canada’s ever-expanding apparel and textiles market. The company has anticipated the said international expansion and has set aside over CAD $300,000 in liquid funds to finance the Canadian subsidiary. The company also has over CAD $1,678,520 in mixed funds and assets that could be available for the expansion venture.

  • The Client has over 12 years of experience in the apparel and textile business and is currently the General Manager of the parent company.
  • The products and services of the parent company include approximately 10,000 SKUs.
  • The parent company generated over CAD $900,000 in revenue in 2019.
  • The initial investment of CAD $200,000 will be provided by the Client to the Canadian subsidiary for the first year of operations.
  • The subsidiary offered the Client to partake an active role, as a Managing Director, in initial business development in the Canadian market.
  • The Client wants his spouse and child to accompany him during his employment in Canada.

Considering that the Client’s main objective was to expand his company’s business to Canada, our business immigration lawyers advised pursuing an Intra-Company Transferee process.

The Timeline of the Case

Since the Client has multiple companies registered in various countries, we proposed to initiate his application from Bahrain, where the parent company is registered and where he holds a residence permit.

On August 12, 2021, we submitted the application through the Canadian Embassy in Abu Dhabi, United Arab Emirates. The Client was not asked to undergo the Medical Examination; however, he did receive the Police Certificate Request on November 3, 2021. Shortly after, our Client’s 2-year C12 ICT Work Permit was approved on November 5, 2021.

Because our Client’s family resides in India, we submitted their application to the Canadian High Commission in New Delhi, India. The spouse applied for an Open Work Permit, and their son applied for a Study Permit, which will allow him to attend world-class Canadian public education institutions for free. We are waiting for the results of these two applications.

The recently approved family is planning on arriving in Canada before the end of 2021 or the beginning of 2022 at the latest. Nothing brings us more joy than seeing new businesses expand and grow and Canada. Although our Client’s situation was “non-traditional”, we are pleased to have navigated the application process that has ultimately resulted in success.
