The Refusal and Reconsideration of the Intra-Company Transfer Application
Our initial application at the heat of the COVID-19 pandemic in Canada was not successful. We submitted the 1st Intra-Company Transfer application on August 24, 2020, and it was refused by the High Commission of Canada in India on February 02, 2021. Being convinced that the application should have been positive, we submitted a reconsideration on March 1, 2021, but it was not accepted by the High Commission. Our team was very surprised with the outcome, but not discouraged at all.
After discussing the negative decision with the Client, we proposed to submit a new application by addressing every concern of the High Commission. The Client agreed and we thank him for his trust placed in our team’s ability.
The New Application and Reiterating that the Client Fully Satisfied the ICT Work Permit Requirements
We obtained the entire file through a request under the Access to Information and Privacy Act (ATIP) and studied each note left by the officer who decided on our client’s application. Then, we resubmitted on March 22, 2021, responding to each concern of the New Delhi office. To our and the Client’s delight, the application was approved on August 09, 2021. The Client has sent his passport to the New Delhi office and is currently waiting for a work visa to be affixed in it. We can’t wait to see our client in person in Canada soon!
The Challenge and the Lesson
